1. Purpose
These Terms govern the use of Prevox (mobile app + prevox.health website). By creating an account you accept these Terms.
2. Account
- You must be at least 16 years old.
- You provide accurate information and keep your password confidential.
- You are responsible for any action carried out from your account.
- Prevox may suspend an account in case of fraudulent or abusive use.
3. Nature of the service
Prevox is a health prevention and personal medical record management tool. Prevox is not a medical device within the meaning of EU Regulation 2017/745 (unless explicitly stated). Prevox does not provide diagnoses and does not replace medical advice.
4. Important, emergencies
In a life-threatening emergency, call 15 (SAMU), 18 (firefighters) or 112 (European emergency number) immediately. Prevox is not an emergency service.
5. Pro Mode for doctors
- Pro Mode is reserved for healthcare professionals.
- Signing up to Pro Mode requires a verifiable professional ID (RPPS, ADELI or national equivalent).
- Pro Mode is free for doctors. No commitment.
- The doctor agrees to access only records explicitly shared with them.
6. Record sharing
- You alone decide who can consult your record, for what, and how long.
- You can revoke a share at any time, without justification.
- Every access is logged, you can verify who saw what when.
- Revoking a share cryptographically destroys the doctor's access (workstream K).
7. Prevox recovery (Shamir escrow)
Prevox recovery (escrow) is on by default; you can turn it off at any time in your security settings. The key to your record is split into 5 shares, each encrypted for one of 5 independent holders (founder, co-founder, notary, a bank in France, a bank outside the European Union); 3 are enough to reconstruct it. A recovery requires your identification, your signed request and the agreement of at least 3 holders, one of them outside Prevox; you are notified as soon as it starts. No one at Prevox can open your record alone.
8. Intellectual property
Your personal data is yours. You grant Prevox a non-exclusive limited licence to host and process it for the purposes listed in the privacy policy. The source code, Ophamir algorithms and Prevox visual identity remain the property of Prevox SAS.
9. Service availability
Prevox targets 99.5% availability. Technical interruptions may occur for maintenance or force majeure. No compensation is due for interruptions under 8 consecutive hours.
10. Liability
- Prevox commits to securing your data with state-of-the-art crypto (see privacy policy section 7).
- Prevox is not liable for damage resulting from unauthorised access linked to a weak password you chose, or a leak outside our infrastructure (e.g. unlocked stolen phone).
- Total liability of Prevox is capped, in accordance with article L221-15 of the French Consumer Code, at the amount paid by the user in the 12 months preceding the claim. For patients (free service), this cap is a symbolic 100 EUR.
11. Personal data
Data processing is detailed in our privacy policy. You have GDPR rights of access, rectification, objection, erasure, portability.
12. Terms updates
Any material change is notified to you 30 days before entry into force. Continued use means acceptance.
13. Governing law and jurisdiction
These Terms are governed by French law. In case of dispute, after amicable resolution attempt, French courts have exclusive jurisdiction.
